The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms of Service:
- “Affiliate” means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
- “Account” means a unique account created for You to access our Service or parts of our Service.

- “Device” means any device that can access the Service such as a computer, a cell phone or a digital tablet.
- “Feedback” means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
- “Service” refers to the Website.
- “Terms of Service” (also referred as “Terms“) mean these Terms of Service that form the entire agreement between You and the Company regarding the use of the Service.
- “Third-party Social Media Service” means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
- “Website” refers to (Femmeville) accessible from (www.femmevilleapp.ca).
- “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Acknowledgment
These Terms of Use (“Terms”) govern your access to and use of the Femmeville App (the “Service”) and form a binding agreement between you (“User”) and Femmeville (“the Company,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Service, you agree to comply with these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not access or use the Service.
You confirm that you are at least 18 years of age. Femmeville does not permit individuals under the age of 18 to create an account or use the Service.
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review it carefully before using Femmeville.
User Accounts
To access certain features of the Service, you may need to create an account. You agree to provide accurate, complete, and current information when creating or updating your account. Failure to do so may result in suspension or termination of your account.
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You agree not to disclose your password to any third party and to notify us immediately at community@femmevilleapp.ca if you suspect unauthorized access or a security breach.
You may not use a username that:

Is offensive, vulgar, or otherwise inappropriate
The company reserves the right to remove or change any username that violates these guidelines.
By creating an account, you also agree to follow our Community Guidelines and acknowledge that We may update these Terms periodically. Updates take effect upon posting within the App or on our website.
User-Generated Content
The company allows users to post, upload, and share content such as text, photos, or comments (“User Content”). You are solely responsible for any content you share and for all activity that occurs under your account.
By posting content on Femmeville, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content as necessary to operate and improve the Service. You retain ownership of your content but acknowledge that other users may view, share, or interact with it in accordance with these Terms.
You represent and warrant that:

Your content does not violate the rights, privacy, or safety of others.

Your content complies with all applicable laws and these Terms.
Community Standards and Prohibited Content
The company is built on respect, empowerment, and kindness. To maintain a safe and inclusive space, you agree not to post, share, or transmit any content that is:

Unlawful or promotes illegal activity

Harassing, discriminatory, or hateful toward individuals or groups based on race, religion, gender, sexual orientation, or other protected characteristics

Sexually explicit, obscene, or violent

Defamatory, misleading, or harmful

Spam or unauthorized advertising, including chain messages or pyramid schemes

Malicious software (viruses, malware, trojans, etc.) or attempts to access others’ data without consent

Impersonating another person, organization, or Femmeville staff

Violating privacy or posting others’ private information without permission

Infringing on intellectual property rights, including copyright, trademarks, or trade secrets

False or fraudulent, including deceptive promotions or offers
Femmeville reserves the right but not the obligation to review, edit, or remove any content that violates these Terms or is deemed inappropriate, harmful, or unsafe. Repeated violations may result in suspension or permanent removal from the platform.
Moderation and Enforcement
The company uses both automated tools and human moderation to keep the community safe.
Users can report objectionable content directly within the app, and We will review and, if necessary, remove such content within 24 hours of confirmation.
Users may also block others to prevent unwanted contact or interactions. The company reserves the right to restrict access, remove content, or terminate accounts that violate our policies.
Content Moderation and Reporting
To maintain a safe and respectful environment:

The company uses automated and manual moderation tools to help filter objectionable content.

Users can report posts or messages that they find inappropriate by using the in-app “Report” feature.

Users can block other users to prevent further interactions.

Reported content will be reviewed promptly, and offending material and/or users may be removed within 24 hours of verification.
If you encounter content that violates these Terms, please report it immediately using the in-app “Report” option or by contacting community@femmevilleapp.ca
Links, Ads, and Third-Party Services
We may display advertisements or contain links to third-party websites and services. These are provided for your convenience only. Femmeville does not own, operate, or control these external sites, and we are not responsible for their content, privacy practices, or actions.
By clicking an advertisement or external link, you acknowledge that you are leaving the Our environment and that any interaction with those sites is governed by their own terms and privacy policies. We strongly encourage you to review those policies before engaging with any third-party website or service.
We are not liable for any loss, damage, or claim arising from your use of or reliance on third-party content, products, or services accessed through the App.
Subscription and Payments
Femmeville offers both free (Basic) and paid (Premium) membership options. Premium users enjoy exclusive features and enhanced app experiences.
Subscription Terms
Subscriptions are available on a recurring basis (monthly or annually) depending on the plan selected.
Payments are handled securely via Apple (for iOS) or Square (for in-app payments). The applicable price, billing frequency, and renewal details are shown before purchase.
Automatic Renewal
Your Femmeville Premium subscription automatically renews unless you cancel at least 24 hours before the current term ends. You may manage or cancel your subscription in your device settings or within Femmeville’s account settings.
Cancellations and Refunds
You may cancel your subscription at any time. Payments are non-refundable, except as required by law.
Refunds for Apple purchases must be requested through Apple Support.
For payments processed through Square, contact community@femmevilleapp.ca for assistance.
Plan and Fee Changes
Femmeville reserves the right to adjust its pricing or subscription structures at any time. Changes will apply upon renewal, and users will be notified in advance.
Account Suspension or Termination
The company reserves the right to suspend or terminate your account at any time if:

You violate these Terms or our Community Guidelines

Your activity poses a risk to other users or the community

You engage in behavior that could harm the company’s reputation or security
Termination may result in loss of access to your content and data.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.
Copyright and Intellectual Property Policy
The company respects the intellectual property rights of others and expects our users to do the same. It is our policy to promptly remove any content that infringes on another party’s copyrights or other intellectual property rights once we are properly notified.
If you believe that material on Femmeville infringes your copyright, please email us at community@femmevilleapp.ca with the following information:

A description or link to the original work that you claim has been infringed.

A description or link to the material on Femmeville that you believe is infringing.

Upon receiving a valid notice, We may remove or disable access to the infringing material and may terminate repeat violators where appropriate.
Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using Femmeville, you consent to the collection and use of your data as outlined in our Privacy Policy.
Intellectual Property
The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.
Content Backups
We perform regular backups to help protect user data, but we cannot guarantee that there will never be data loss or corruption. Backups may fail or become invalid due to factors beyond our control, such as system errors or corrupted content. We will make reasonable efforts to troubleshoot and resolve any backup-related issues we discover. However, Femmeville is not responsible for any loss of data or failure to restore content. We encourage users to maintain copies of any important information or media they upload or share within the app.
Your Feedback to Us
We love hearing from our community! If you share ideas, feedback, or suggestions with Femmeville (“Feedback”), you agree that we may use your Feedback to improve our products and services without any restriction or obligation to compensate you.
You acknowledge that:

Your Feedback is provided voluntarily and without expectation of payment or recognition.

Femmeville may use, modify, and incorporate your Feedback into current or future features, products, or services.

You grant Femmeville a worldwide, perpetual, irrevocable, royalty-free license to use your Feedback for any purpose related to improving our platform.
Disclaimer & Limitation of Liability
The Company is provided “as is” and “as available.” We make no warranties, express or implied, regarding the reliability or availability of the App. The Company is not responsible for user-generated content or any damages resulting from interactions between users.
Use at Your Own Risk
Your use of the Femmeville App is entirely at your own risk. Femmeville is not a substitute for professional advice, including but not limited to mental health, medical, legal, or financial guidance.
Always seek the advice of a qualified professional or medical doctor regarding any questions or concerns you may have.
We do not endorse, verify, or assume responsibility for any member content, opinions, or advice shared within the App. You are solely responsible for how you interpret or act upon any information provided by other users.
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 CAD if You haven’t purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some Provinces do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these Provinces, each party’s liability will be limited to the greatest extent permitted by law.
Governing Law
These Terms and your use of Femmeville shall be governed by and construed in accordance with the laws of the Province of New Brunswick, Canada, without regard to conflict of law principles.
Your use of the App may also be subject to other local, provincial, national, or international laws depending on your location.
Disputes Resolution
If you have any concern, complaint, or dispute about the Service, we encourage you to contact us first at community@femmevilleapp.ca so we can attempt to resolve the matter informally and in good faith.
If a resolution cannot be reached informally, the dispute will be governed by the laws of New Brunswick, Canada, and handled exclusively in the courts located in New Brunswick.
Canada Legal Compliance
You agree to comply with all applicable laws and regulations of Canada when using the Femmeville App.
You also represent and warrant that you are not located in a country subject to Canadian trade restrictions and are not on any Canadian government list of prohibited or restricted parties.
Indemnification
You agree to indemnify and hold harmless Femmeville, its founders, employees, and affiliates from any claims, damages, or expenses arising from your use of the App or your violation of these Terms.
Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Changes to These Terms of Service
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
